1.Acceptance of Terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2.Definitions
Capitalised terms used throughout these Terms have the meanings given below.
- “Service”
- The Datafolio website, platform, and all features available at datafolio.online, including the portfolio builder, AI-assisted writing tools, resume generator, and any related APIs or integrations.
- “Company”
- datafolioOnline, a company registered in Kenya, operating the Service. References to “we,” “us,” or “our” mean the Company.
- “User”
- Any individual who accesses or uses the Service. References to “you” or “your” mean the User.
- “Account”
- A registered user account created on the Service by providing an email address and password.
- “Portfolio”
- A personal portfolio page created by a User within the Service and hosted at a unique URL on the Service.
- “Content”
- Any information, text, images, links, or other material a User submits, uploads, or publishes through the Service, including bio, project descriptions, and any AI-generated text saved to a User’s Account.
- “Subscription”
- A paid plan that grants access to premium features of the Service, as described on the pricing page, for a defined billing period.
- “Free Tier”
- Access to a limited set of Service features at no charge, subject to the restrictions in Section 9.
3.Description of Service
Datafolio is a SaaS platform that enables data analysts and similar professionals to:
- ›Create, edit, and publish a personal portfolio website at a custom URL.
- ›Generate a downloadable resume PDF from portfolio data.
- ›Use AI-assisted tools to write project case studies, LinkedIn blurbs, and narrative summaries.
- ›Receive AI-generated feedback on their portfolio (“roast” feature).
The specific features available to you depend on your plan tier. We reserve the right to modify, add, or remove features of the Service at any time with reasonable notice where removal would materially affect paid functionality.
4.Eligibility
- ›Age. You must be at least 13 years old to use the Service. By creating an Account, you represent that you meet this requirement. Users between 13 and 18 must have parental or guardian consent.
- ›Accurate information. You must provide accurate, current, and complete information when creating an Account and keep it up to date.
- ›No prior bans. You may not use the Service if we have previously terminated your Account for a violation of these Terms.
- ›Legal capacity. You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
5.Account Responsibilities
- ›You are responsible for maintaining the confidentiality of your Account credentials (email and password) and for all activity that occurs under your Account.
- ›You must notify us immediately at contact@datafolio.online if you suspect unauthorised access to your Account.
- ›You may not share your Account with others or allow others to access the Service using your credentials.
- ›You are solely responsible for ensuring that any Content you publish through the Service does not violate applicable law or third-party rights.
6.Acceptable Use Policy
You agree not to use the Service, or permit any third party to use the Service, to:
- ›Upload, publish, or transmit Content that is unlawful, defamatory, harassing, threatening, obscene, fraudulent, or that infringes any third party’s intellectual property, privacy, or other rights.
- ›Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
- ›Distribute spam, unsolicited commercial messages, or malware through any Service feature, including your published Portfolio.
- ›Attempt to gain unauthorised access to the Service, other users’ accounts, or any system or network connected to the Service.
- ›Probe, scan, or test the vulnerability of any Service system, or bypass any authentication or security measures.
- ›Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service at a scale that places excessive load on our infrastructure, without our prior written consent.
- ›Reproduce, resell, or sublicense access to the Service or any portion of it.
- ›Use the Service in any manner that violates applicable local, national, or international law or regulation.
We reserve the right to investigate suspected violations and, at our discretion, suspend or terminate access to the Service, remove Content, or take other appropriate action.
7.User Content and Licensing
Ownership. You retain full ownership of all Content you create or upload through the Service. These Terms do not transfer any intellectual property rights from you to us.
License to Datafolio. By uploading or publishing Content through the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and deliver that Content solely as necessary to operate and provide the Service. This licence ends when you delete the Content or your Account, subject to the retention periods in our Privacy Policy.
Public portfolios. When you publish a Portfolio, you acknowledge that it will be publicly accessible and indexable by search engines. If you later unpublish it, we will remove it from active serving; cached copies held by third-party search engines or social platforms are outside our control.
Your representations. You represent and warrant that you own or have the necessary rights to all Content you submit, and that your Content does not violate any third-party rights or applicable law.
8.Subscriptions, Billing, and Payments
Plan tiers. The Service is offered on a Free Tier and one or more paid Subscription tiers, as described on our pricing page. Pricing and features are subject to change as described below.
Billing cycles. Paid Subscriptions are billed on the cycle described at the time of purchase (monthly or annual). Your Subscription renews automatically unless you cancel before the renewal date.
Payment processors. Payments are processed by our third-party payment processors:
- ›Cryptocurrency (NowPayments). Payments made in USDT, USDC, or other supported cryptocurrencies are processed by NowPayments. Cryptocurrency payments are final and non-refundable once confirmed on the blockchain, due to the irreversible nature of blockchain transactions.
- ›Card payments (Lemon Squeezy). Where available, card payments are processed by Lemon Squeezy.
Refund policy. All payments made through the Service — including Subscriptions, one-time purchases, and add-ons — are final and non-refundable, regardless of payment method or plan tier. Cryptocurrency payments processed via NowPayments are irreversible by the nature of blockchain transactions and cannot be recalled or charged back. This same no-refund policy applies equally to card payments processed via Lemon Squeezy and to any future payment methods added to the platform. By completing any purchase on the Service, you acknowledge and accept that no refund will be issued under any circumstances, to the fullest extent permitted by applicable law.
Price changes. We may change Subscription pricing at any time. For existing Subscribers, price changes will take effect at the next billing cycle after we provide at least 30 days’ notice by email. Continued use of a paid Subscription after the effective date constitutes acceptance of the new price.
Cancellation. You may cancel your Subscription at any time through your account settings or the billing portal link in your dashboard. Cancellation takes effect at the end of the current paid period; you retain access to paid features until then.
9.Free Tier Terms
- ›The Free Tier provides access to a limited feature set as described on the pricing page, including a cap on the number of projects per Portfolio and a subset of available themes.
- ›We do not guarantee that the Free Tier will remain available indefinitely. We reserve the right to modify, limit, or discontinue the Free Tier with 30 days’ notice.
- ›Free Tier users may be shown branding identifying the Portfolio as built with Datafolio. Removing this branding requires a paid Subscription or the Launch Pack add-on.
- ›There is no charge for the Free Tier; accordingly, no refunds are applicable.
10.Intellectual Property
Datafolio’s IP. The Service, including its software, code, design, UI, graphics, trademarks, and the “Datafolio” name and logo, are owned by the Company or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Datafolio’s trademarks, trade names, or branding without our prior written consent.
Feedback. If you provide suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free right to use and incorporate that feedback without obligation to you.
AI-generated content. Text generated by AI features at your request is provided for your use. The ownership and copyright status of AI-generated outputs varies by jurisdiction; you are responsible for understanding your local law regarding such content before relying on it commercially.
11.Termination
Termination by you. You may stop using the Service and delete your Account at any time through the dashboard. Upon deletion, your published Portfolio will be taken down and your data processed in accordance with our Privacy Policy.
Termination by us. We may suspend or terminate your access to the Service, with or without notice, if:
- ›You violate these Terms or our Acceptable Use Policy.
- ›We are required to do so by law or a court or regulatory authority.
- ›We decide to discontinue the Service (with 30 days’ notice for paid Subscribers where practicable).
Effect of termination. On termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 7, 10, 12, 13, 14, and 15) will continue to apply.
12.Disclaimers and Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.
We do not warrant that:
- ›The Service will meet your specific requirements or expectations.
- ›Any AI-generated content will be accurate, complete, or suitable for any particular purpose.
- ›The Service will be available at any particular time or location.
- ›Errors or defects will be corrected within any specific timeframe.
Some jurisdictions do not allow the exclusion of implied warranties. To the extent such exclusions are not permitted under applicable law, this disclaimer applies only to the fullest extent permitted.
13.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY, ITS DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.
14.Indemnification
You agree to indemnify, defend, and hold harmless the Company and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property or privacy rights. We reserve the right to assume exclusive control of any matter subject to indemnification by you, and you agree to cooperate with our defence of such claims.
15.Governing Law and Dispute Resolution
Governing law. These Terms will be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law rules.
Mediation. Before initiating arbitration or litigation, both parties agree to attempt in good faith to resolve the dispute through mediation. Either party may initiate mediation by providing written notice to the other at contact@datafolio.online. If the dispute is not resolved through mediation within 60 days of that notice (or such longer period as both parties agree to in writing), either party may proceed to arbitration as set out below.
Arbitration. If mediation fails to resolve the dispute, it shall be finally and bindingly settled by arbitration administered by the Nairobi Centre for International Arbitration (NCIA) under its Arbitration Rules as in force at the time the dispute is referred. The seat of arbitration shall be Nairobi, Kenya. Proceedings shall be conducted in the English language. The arbitrator’s award shall be final and binding on both parties and may be enforced in any court of competent jurisdiction.
Nothing in this section limits either party’s right to seek emergency injunctive or other equitable relief in any court of competent jurisdiction.
16.Changes to Terms
We may modify these Terms at any time. When we make material changes, we will:
- ›Update the “Last updated” date at the top of this page.
- ›Notify registered Users by email at least 30 days before the changes take effect, for material changes that affect your rights.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and may delete your Account.
17.Severability
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.
18.Entire Agreement
These Terms, together with our Privacy Policy and any additional terms applicable to specific features (e.g., add-on purchase confirmations), constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements, representations, and understandings, whether written or oral, relating to the same subject matter. No waiver of any term of these Terms will be deemed a further or continuing waiver of that term or any other term.
